Human Right Violations in Iran (April Report, 2015)

The Iranian Intelligence Agency, Ettelaat has made a number of unlawful arrests in many cities of South Azerbaijan and the capital, Tehran.

This morning the Persian Ettelaat agents stormed into another well-known activist, Alireza Farshi’s residence in Tehran, performed an illegal search, confiscated his personal computers and belongings, arrested and immediately transferred him to the Iran’s notorious Evin Prison.
He is believed to be one of the activists behind a country-wide campaign aimed to obtain permission for peaceful demonstrations in Tehran and some cities of South Azerbaijan.

Prior to Farshi’s detention, Ettelaat detained other activists including Aidin Zakeri, Ali Rezayi, İslamli Akbarli, Araz khassetaraş Amin Hajili and many others intending to prevent the planned peaceful protests which would merely demand the very basic right of education in mother language for over 35 million Azerbaijani Turks.Azerbaijani activists, Behnam Sheikhi, Rustam Kazempur, Mahmud Ojaqlu, and Hamid Manafi were arrested by Tehran’s intelligence Service, Ettellat.
They are believed to have been held in Ettelaat’s detention centre. Early in March 2015, Ali Rezayi, Alireza Farshi, Akbar Azad and Mansur Fathi were detained by Iran’s security forces and are being held in Tehran’s notorious Evin prison.
Reportedly, the activists were detained for their alleged involvement to organize a rally on 21st February, the International Mother Language Day. xoyAccording to media outlets, the activists made attempts to obtain a permission from the Tehran Municipality to organize a peaceful protest demanding the basic right of education in mother language for over 30 million Azerbaijani Turks.
The Azerbaijani activist Mahmud Fazli has told his wife on their last phone conversation that he has started an indefinite hunger strike demanding re-opening of his and other Yeni GAMOH leaders’ case.
He told his wife on the phone that he had an argument with Tabriz Prison’s director as the director refused to submit his application for re-opening of his matter. The prison director insulted Mr. Fazli and ordered his transfer to the Unit of Drug Addicts. Mr. Fazli has declared an indefinite hunger strike in response.Milletci zindani (3)

Mahmud Fazli and Latif Hasani, Ayat Mehralibegli, Shahram Radmehr, and Behbud Qulizade the leading members of Yeni GAMOH were arrested in December 2012- January 2013 and convicted of “conspiracy to subvert Islamic Republic by establishing a clandestine group of Yeni GAMOH, New Southern Azerbaijan National Awakening Movement,” The Yeni GAMOH leaders were sentenced to 9 years incarceration

Oguz Kaan

Iran’s Registrar has refused to issue a birth certificate to a South Azerbaijani child for over 3-5 years. The now 3.5 – year-old Oguz Kaan has no birth certificate or national identification documents since the Registrar Office of the city of Maku believes that Oguz Kaan’s Turkic name is un-Islamic.
Oguz Kaan’s father Sadiq Feyzulla Nejad says he attended the Registrar’s Office to obtain birth documents as soon as Oguuz Kaan was born. However, the Register refused to issue a birth certificate to Oguz Kaan. Oguz Kaan’s father took the matter to the court. Yet, the court upheld the Ragistrar’s unlawful and ridiculous decision that the Turkic name Oguz Kaan is against Islamic rules and culture. Consequently, Oguz Kaan merely due to his name has been deprived of his basic social rights. Oguz Kaan’s father is worried that his son would not be able to go to school since he has no identification.

South Azerbaijani political prisoner Ali Rezayi’s spouse, Mrs. Shiva Dadahszade was detained on February 8th 2015 and subjected to a lengthy interrogation at the Ettelaat’s Tehran Division.

During the interrogation she was directed to refrain from disseminating information on her husband’s detention. Shiva was threatened that in case she fails to comply with the Iran’s spy agency’s directive, she will be imprisoned for “anti-state propaganda.” Ettelaat confiscated Mrs. Dadashzadeh’s national identity card and released her on her recognizance.

Mr. Rezayi was arbitrarily detained at the Mehrabad International Airport on February 4, 2015. Iranian authorities have rejected his family’s repeated requests for information on Mr. Rezayi’s whereabouts and his circumstances.Mr. Rezayi’s lawyer has not been able to visit his client and no criminal charges have been laid as of yet.Human Rights Advocates fear for Mr. Rezayi’s well-being and believe that he is at risk of tortured and ill-treatment.

Mohammd Tamaddon and Yaser Akbari both entered a not guilty plea. They rejected the spy agency- Ettelaat’s and the prosecutor’s allegations saying that they were simply watching a karate contest in the city’s gymnasium. The court deferred its decision.
The spy agency arrested the young activists along many others during a Martial Arts Contest in Urmia’s “Ghadir” Gymnasium, and criminal charges were laid. The activists were later released on a bail.No crime is designated or identified in Iran’s Criminal Code which bans or penalizes citizens who pose with a foreign flag.

Abulfazl Rajabi of the city of Miyana, South Azerbaijan who was allegedly tortured to death was buried in the city’s cemetery 6 months after his death. The victim’s parents and his legal counsel insist that the 20 years old victim was severely beaten, tortured and ill-treated while being held in the solitary confinement of the Miyana Police Division

However, the city’s prosecutor has repudiated the allegations and claimed that Mr. Rajabi “hanged himself to death using his underpants’ rubber band”, an allegation ridiculed by victim’s family and human rights’ activists.
İn an audio statement released by the victim’s lawyer, the victim’s father said he was confident his son “was tortured to death in a failed attempt to coerce a confession to a crime of theft which he did not commit.”The victim’s legal counsel also released a statement emphasizing his client was a healthy young man and that the victim neither suffered any mental issue nor was he suicidal.
The victim’s body was being kept in the city’s morgue for a vigilant forensic investigation, the result of which has not been released for mysterious motives.
 
A Prominent South Azerbaijani patriotic activist, Mr. Abbas Lisani has refused to appear for his trial at the Islamic  Revolutionary Tribunal of the Province of Ardebil due to the court’s denial to hold an open hearing.

The South Azerbaijani journalist Said Matinpur’s family has raised serious concerns over his health condition. His family reported that Mr. Matinpur has been suffering from various infectious syndromes such as severe teeth, gum and ear infections with a risk of dispersion to his blood or other organs. The correctional facility has failed to provide him with adequate medical attention.
Said’s mother has told local media that Said is merely allowed to take the antibiotics supplied by the family, and he has no access to medical care. She also revealed that undelivered promises were made by judicial system about the prisoner’s conditional release following his said-matinpourallocation to Zengan prison in September 2014.
Mr. Matinpur was arrested 6 years back on false charges of “Attempt of Subversion of Islamic State” and “Espionage” and convicted to 8 years in prison. Mr. Matinpur was being held at Tehran’s Evin Prison. After political prisoners’ protest in Evin Prison Matinpur was transferred to a prison in Zengan, South Azerbaijan.

Mr. Lisani’s trial was set to proceed on 2 tims :  April 2015 and decmbr 2014. Months prior to the date of trial, he made repeated requests to hold a public hearing.  However, the court repudiated to grant his requests and insisted that the trial would be held in camera due to national security concerns. Therefore, Mr. Lisani refused to appear for the scheduled trial.

Mr. Lisani filed his most recent application with  the Revolutionary Tribunal of Ardebil on December the 1st 2014 in which the movement leader asserted that pursuant to the article 168 of the Iranian Constitution and rules of the court, he is entitled to his constitutional right to have a public trial by an impartial jury and attended by independent journalists.
 
Mr. Lisani is accused of “conspiracy against Iran’s national security” due to his participation at Babak Castle and Lake Urmia and other protests.
 
Mr. Lisani has suffered massive pressures due to his peaceful activities  including years of in- exile- imprisonment at Yazd (Central Iran) Prison.Reportedly, in the most recent attempt to silence the movement leader, Mr. Lisani’s teenager son, Oktay has been summoned to Ardebil’s Ettelaat Department for unidentified reasons.
